1. Introduction
a. Reeve Management Pty Ltd As Trustee ABN 41235495947 ("SportsPower
Northern NSW”, "we”, "our”, or "us”) runs a loyalty program known as the
Gold Medal Rewards Club ("Program”).
b. Each Member consents and agrees to receive marketing information, offers
and special discounts from Sportspower Northern NSW by email, mail and SMS
(where such information has been provided by that person).
2. Membership
a. Membership of the Program is only available to individuals who are
permanent residents of Australia. Membership is for personal use only and
not to be used by or on behalf of any business or company.
b. Individuals may apply to be a Member by providing their details to a
staff member in one of our stores, or by placing on order online at
www.superwh.com.au
c. Employees of Sportspower Northern NSW, and employees of suppliers to
Sportspower Northern NSW, are not eligible to be a Member.
d. Application for membership is at the sole discretion of Sportspower
Northern NSW. If an applicant does not provide information that we consider
necessary, that applicant may not be eligible to participate in the
program.
e. Offers and features of the Program are only available at Sportspower
Northern NSW stores, and not at any other "Sportspower” or "Sportscene”
stores in Australia.
f. Each Program card remains the property of Sportspower Northern NSW. The
card is not transferable and is not a credit or charge card.
g. Each member must maintain a valid postal address and email address with
Sportspower Northern NSW and notify Sportspower Northern NSW of
i.Any change of email or postal address; and
ii. A lost or stolen card.
h. If a card is lost or stolen, a replacement may be obtained by visiting
Sportspower Northern NSW. Issuing of a replacement card is at the sole
discretion of Sportspower Northern NSW and a fee of $5 may be charged.
3. Participation
a. Participation in the Program is subject to the full terms and conditions
and any variations to them.
b. To participate in the Program a Member is required to present his or her
Card, or identify themselves as a member to Sportspower Northern NSW by
providing personal information which matches up with the personal
information the Member has previously provided to us. By providing these
details in order to be identified as a Member, each Member agrees to be
bound by these Terms and Conditions.
c. Should a Member forget to present their card or identify themselves as a
participant in the Program for a particular transaction, they may attend a
Sportspower Northern NSW store within 2 business days of the transaction to
have the transaction reversed and reprocessed against the Member’s account,
however the Member loses this right after 2 business days, and the
transaction can no longer be processed against a customer’s account, and
any points or benefits are foregone.
d. Membership benefits do not apply to any transactions which took place
prior to the Member joining the Program.
e. A Member may opt out of the program at any time in writing or by
attending a Sportspower Northern NSW store in person. While this will
remove the Member from the Program, and remove the Member from any future
communications, Sportspower Northern NSW will retain the Member’s details
for accounting and prudent record keeping purposes.
f. Each card may only be used at Sportspower Northern NSW or online at
www.superwh.com.au
g. Any liability arising out of or in any way connected with a Members’
participation in the Program is the responsibility of that Member.
h. All conditions and warranties, whether express or implied and whether
arising under statute or otherwise, as to the condition, suitability,
quality, fitness or safety of any goods or services supplied under the
Program are expressly excluded to the full extent permitted by law. Any
liability Sportspower Northern NSW may have to a Member under statute in
respect of such goods and services which cannot be excluded is limited,
where permitted, to supplying, or paying the cost of supplying the goods or
service again or repairing, or paying the costs of repairing, the goods, at
the sole discretion of Sportspower Northern NSW.
4. Reward Discounts
a. Every $1 that you spend with Sportspower Northern NSW is tracked in our
computer system. Once a Member’s total dollar spend reaches a Threshold
Amount (as set on the Sportspower Northern NSW website from time-to-time)
they will be issued with a Reward Discount (as set on the Sportspower
Northern NSW website from time-to-time).
b. Any refunds or reversed transactions will serve to reduce the tracked
balance, and potentially reduce or remove any Reward Discount.
c. The Reward Discount can only be used against the next purchase made at
Sportspower Northern NSW either in store on online at www.superwh.com.au
d. Reward Discount dollars will not accrue for any administrative costs if
the Card is lost and replaced, nor for any amount spent on merchandise
provided by a third party collecting for charitable purposes.
e. Reward Discounts issued under the Program are not transferable, are not
redeemable for cash and are not negotiable instruments.
f. The Threshold Amount and Reward Discount noted above are at the absolute
discretion of Sportspower Northern NSW and may be modified at any time
without notice.
5. Cancellation
a. Sportspower Northern NSW reserves the right to vary these terms and
conditions at any time and to suspend or cancel the Program and/or the Card
at any time upon reasonable notice.
b. Sportspower Northern NSW will make all reasonable efforts to communicate
advance written notice of such changes using methods including, but not
limited to, notification on the Website.
c. A Member who continues using their Card after the expiry of Advance
Notice will be deemed as accepting the amended Terms and Conditions, the
Program, any benefits and discounts available under the Program and any
membership (as the case may be).
d. Sportspower Northern NSW may terminate a Member’s participation in the
Program without notice for any reason including, without limitation, if a
Member:
i. Fails to comply with these Terms and Conditions.
ii. Provides Sportspower Northern NSW with any misleading information.
iii. Does not make a purchase at Sportspower Northern NSW for a period of
12months.
e. Should Sportspower Northern NSW cancel the Program for any Member or in
whole, Reward Discounts will also be cancelled immediately, and the member
has no further claim or right to any Reward Discount or Program benefit,
whether previously accrued or otherwise.
6. Privacy Statement
a. A Member can access his or her personal information held by Sportspower
Northern NSW by contacting us at PO Box 1001, Byron Bay NSW 2481
b. The purpose of Sportspower Northern NSW collecting personal information
is for a Member to participate in the Program. This privacy statement and
these terms and conditions form part of each other. Sportspower Northern
NSW does not sell or lease personally identifying information (such as your
name, address, telephone number, bank and credit card numbers) to
non-affiliated companies or entities.
c. Sportspower Northern NSW do record information regarding purchases made
with your GMR Card to help us provide you with special offers and other
information. Sportspower Northern NSW also may use this information to
provide you with personally tailored offers, invitations or other
information that by be provided to Sportspower Northern NSW by other
companies.
7. Other Rewards and Offers
a. Members may be given the opportunity to enter competitions and receive
offers. Competitions and other offers will be subject to their own terms
and conditions which will be available in store and at www.superwh.com.au.
b. Competitions may limit certain Members from entering or claiming a prize
or offer.
8. General
a. The Card and the technology utilised by the Program depend on third
parties, and Sportspower Northern NSW is not responsible for computer or
technological errors or failures, or for fraud, as they relate to these
third parties.
b. Third parties involved in the Program do not have any authority, express
or implied, to make any representation, warranty or statement on behalf of
Sportspower Northern NSW and Sportspower Northern NSW accepts no liability
in respect of such representations, warranties or statements.
